01 Purpose and acceptance
These terms of service and sale ("Terms") govern access to and use of the BlueBird Discord bot, its website and its control panel (together, the "Service"), published by the person identified in the legal notice (the "Publisher").
By adding BlueBird to a server, using its commands or signing in to the panel, you accept these Terms in full. If you do not accept them, do not use the Service.
02 Access to the Service
- The basic Service is free; some features are reserved for Premium subscribers.
- Using the Service requires a valid Discord account and compliance with Discord's Terms of Service and Community Guidelines, including the minimum age Discord requires in your country.
- Access to a server's control panel is restricted to members holding the required administration permissions on that server.
- The Service is provided "as is". The Publisher strives to keep it available but does not guarantee uninterrupted access: maintenance, updates, Discord or hosting outages may interrupt it.
03 Acceptable use
You agree not to use the Service to:
- share unlawful, hateful, harassing, sexually exploitative, violent content or content infringing third-party rights;
- send spam or unsolicited messages, or circumvent Discord's limits;
- attempt unauthorised access to systems, data or accounts, or disrupt the Service (attacks, overload, reverse engineering, exploiting vulnerabilities);
- resell, rent or commercially exploit the Service without the Publisher's written consent;
- manipulate the economy, levelling or mini-game systems through automation (macros, alt accounts).
Server administrators are responsible for how the bot is configured on their server (automatic messages, sanctions, roles, custom commands) and for informing their members.
04 Artificial intelligence features
Some features (assistant, copilot, text generation) rely on third-party AI models. Generated answers may be inaccurate or incomplete: they are not professional advice (legal, medical, financial…) nor a statement by the Publisher. Do not share sensitive information with these features.
05 Premium plans — terms of sale
5.1 Plans and prices
Premium plans and prices are shown on the Premium page, including all applicable taxes. The Publisher may change prices at any time; the price displayed at the time of order applies.
5.2 Ordering and payment
Subscriptions are taken through the support server [or: through payment provider X]. Payment is due immediately. The Publisher stores no card data.
5.3 Term and renewal
Subscriptions run for the selected period (monthly, semi-annual or annual) and apply to the Discord server designated at order. [Specify whether renewal is automatic.] You may cancel at any time; cancellation takes effect at the end of the current period.
5.4 Right of withdrawal (EU consumers)
Under Article L.221-18 of the French Consumer Code, consumers have 14 days from subscription to withdraw without giving a reason by contacting the Publisher. If you expressly request immediate activation of Premium benefits before this period ends, you will owe an amount proportional to the service already provided (Article L.221-25). The right of withdrawal no longer applies once the service has been fully performed with your prior express consent (Article L.221-28 1°).
5.5 Refunds
Outside the withdrawal period, started periods are not refunded, except in case of breach by the Publisher or a prolonged outage attributable to it.
06 Suspension and termination
The Publisher may, without notice, restrict or remove access to the Service for any user or server that breaches these Terms or Discord's rules, including by adding the server to a block list. A suspension for serious breach does not entitle a Premium subscriber to any refund.
You may stop using the Service at any time by removing BlueBird from your server.
07 Liability
The Publisher has a best-efforts obligation. It is not liable for: content posted by users or configured by administrators; data loss caused by Discord or a third party; non-compliant use of the Service; indirect damages. Nothing in these Terms limits the statutory rights of consumers, including the legal guarantee of conformity for digital content and services.
08 Intellectual property
The Service and its components remain the exclusive property of the Publisher. You keep the rights to content you create (messages, embeds, custom commands) and grant the Publisher a limited, non-exclusive, royalty-free licence to host and display it solely to provide the Service.
09 Personal data
Processing of your data is described in the Privacy Policy.
10 Changes to these Terms
The Publisher may update these Terms. Material changes are announced on the support server or on this site before they take effect. Continued use of the Service means you accept the new version.
11 Governing law and disputes
These Terms are governed by French law. In case of dispute, please contact the Publisher first to seek an amicable solution.
Consumers may use the consumer mediator free of charge: [mediator name and contact details]. Failing agreement, the competent French courts will have jurisdiction, subject to mandatory rules protecting consumers.
